$11,000,000.00 Settlement for Misclassified Managers & Assistant Managers
$11,000,000 Settlement, Misclassified Managers
Managers and assistant managers were classified as exempt employees despite spending the majority of their time on non-managerial tasks, stocking shelves, cashiering, and other clerk-level work. Under California law, employees who spend more than 50% of their time on non-exempt tasks must be paid overtime. Kingsley Szamet established the misclassification and secured an $11 million settlement on the workers' behalf.
What This Means for You
Job titles don't determine exemption status, actual job duties do. If your employer has classified you as exempt but your day-to-day work is primarily non-managerial, you may be owed overtime pay regardless of your title.
Contact Kingsley Szamet Employment Lawyers if you believe your classification doesn't reflect the work you actually perform.
