$11,000,000.00 Settlement for Misclassified Managers & Assistant Managers
$11,000,000 Settlement — Misclassified Managers
Managers and assistant managers were classified as exempt employees despite spending the majority of their time on non-managerial tasks — stocking shelves, cashiering, and other clerk-level work. Under California law, employees who spend more than 50% of their time on non-exempt tasks must be paid overtime. Kingsley Szamet established the misclassification and secured an $11 million settlement on the workers' behalf.
What This Means for You
Job titles don't determine exemption status — actual job duties do. If your employer has classified you as exempt but your day-to-day work is primarily non-managerial, you may be owed overtime pay regardless of your title.
Contact Kingsley Szamet Employment Lawyers if you believe your classification doesn't reflect the work you actually perform.
