Overtime · Meal and Rest Breaks · Minimum Wage
At Kingsley & Kingsley, a California labor law firm
based in Los Angeles, we find that employers routinely ignore wage and
hour laws governing hourly compensation. If you feel you are not being
paid fairly, contact our office
and make arrangements for a free consultation. Even if your personal
claim is small, we may be able to combine it with others in a large
class action to recover your unpaid wages.
How do I recover unpaid overtime?
Laws, both state and federal, require employers to pay employees who
work over 40 hours a week or 8 hours a day 1 ½ times their regular rate
for the overtime hours. If an employee works over 12 hours a day, the
additional hours must be paid at double the regular rate. At Kingsley
& Kingsley, we handle many claims for unpaid overtime – we have
recovered unpaid overtime for clients who were clearly expected to work
more than forty hours and turn in only eight hours on their time card. Contact our lawyers to discuss your situation.
Are meal breaks and rest breaks required under California labor law?
Rest periods are required. If you work more than 5 hours you are
entitled to a 30 minute meal break. If you work more than 4 hours you
are entitled to a 10 minute paid rest break.
Can my employer require me to work before I punch in and attend meetings and training off-the-clock?
You are entitled to be paid for any required meetings, training, and
should not be expected to work when you are not punched in, including
set up work.
My paycheck comes from another state, and it takes days before it clears and can be used – is this legal?
Your pay has to be available for your use as soon as it is issued.
I think my employer has classified me as exempt to avoid paying overtime – what types of employees are typically misclassified?
We have helped many employees, including computer professionals, stock-brokers, and those paid piece-rate, commission or salary collect unpaid overtime. Call a labor law attorney at our firm to find out whether you are really exempt.
